Filing a patent in Italy from abroad
We prepare and coordinate an Italian patent filing for an applicant abroad: the route, the dated deadlines, the address for service and the state fees. We are neither a mandatario abilitato (registered patent attorney) nor a law firm. Representation before UIBM is optional, and only an enrolled industrial-property consultant or a lawyer may act (Art. 201 CPI).
We work for a founder or company outside Italy with a first filing at home, a holder of a European patent to bring into force in Italy, and a group that wants its Italian company to hold the patent. UIBM examines and grants. Regulatory files, such as CASP authorisation in Italy, run on pages of their own.
Routes to protection in Italy
A patent protects only where it is granted (Milan Chamber of Commerce). Five titles reach Italy; the conditions below do not choose one for you.
Italian patent for invention
Filed for UIBM at a Chamber of Commerce, online or by post. The paper filing tax is set by pages, from EUR 120, and covers the first 4 years (Milan chamber).
Utility model
An improved version of an existing product. EUR 120 covers the first five years, and UIBM may accept an invention filing as a utility model, keeping the filing date (Milan chamber).
European patent validated in Italy
Granted by the EPO, then validated at a chamber within three months of issue with an Italian translation, as Italy is not in the London Agreement. Protection equals a national patent.
PCT international application
One application through WIPO; Italy is then reached through a national or a regional (EPO) phase, where the title is granted (Milan chamber).
Registered design
The disegno o modello: filing tax EUR 50 online or EUR 100 on paper, valid 5 years and renewable in 5-year periods up to 25 years (MIMIT, marks and designs page).

The claims are drafted by the inventor or a patent attorney; representation before UIBM belongs to an enrolled consultant or a lawyer; UIBM decides.
From the priority date to the annual fees
Decide who owns the patent
You, or an Italian company. The company can elect the super-deduction for R&D on protected intangibles only once it exists and holds business income (Art. 6(1) D.L. 146/2021, 2026 law).
Check the priority clock
A first filing in a Paris Convention state leaves 12 months to file the same application in Italy; once it is public and the 12 months have run, protection cannot be extended (Milan chamber).
Prepare the technical text
Description, claims, abstract and drawings, written by the inventor or a patent attorney. Claims also filed in English avoid the EUR 200 charge (Milan chamber, filing fees).
Fix the address for service
A domicile in an EU or EEA state, and a PEC for a business (Art. 147 CPI). Done before filing.
File
You, or an enrolled agent you appoint, file: on paper at a Chamber of Commerce, on the UIBM portal with SPID, CIE, CNS or eIDAS, or by post to UIBM. We prepare the file.
Pay the filing tax within one month
By the pre-filled F24 (code C300) or the euro transfer to the Treasury account, within one month of filing (Art. 7(4-bis) L. 102/2023, as the Milan chamber cites it). Late payment makes the application irricevibile (inadmissible).
Examination and grant
UIBM examines the application; the prior-art search is carried out almost entirely at UIBM's charge (UIBM, fees and tariffs page). The sources we read publish no term for the grant, so we give none.
Keep it alive
Annual fees run from year 5, due by the last day of the filing month; six months' grace costs a EUR 100 surcharge, then the title lapses. After a late grant, four months to pay without surcharge (Milan chamber).

Problems we solve for applicants abroad
Where a filing from abroad stalls, and what we do.
- No address in the EU or EEA
Without a domicile, UIBM serves its notices by posting them on its noticeboard, and they count as served (Art. 147 CPI). We fix the address for service before filing.
- No SPID, CIE, CNS or eIDAS
The UIBM portal accepts only these logins (Reggio Calabria Chamber of Commerce). Without them, you file on paper at a chamber, or an enrolled agent you appoint files; we prepare either file.
- A foreign bank and no codice fiscale
An F24 asks for the payer's Italian codice fiscale. Without one, the fee goes by euro transfer to the Treasury account at the Banca d'Italia, details on UIBM's fees page. We prepare the transfer.
- A missed clock
One month for the filing tax, three months to validate a European patent, annual fees by the last day of the filing month. We keep all of them in one dated calendar.
- A holder that cannot use the patent box
The 2026 option is for holders of business income; a non-resident entity qualifies only from a treaty country with effective exchange of information (Art. 6 D.L. 146/2021). A holder can also come from buying an existing Italian S.r.l. instead of forming one.

Frequently asked questions
Can a foreign company or founder file an Italian patent?
Yes. Every applicant must state or elect a domicile in a European Union or European Economic Area state, and a business, a professional or their agent also gives a PEC (certified email) address. Without a domicile, UIBM serves its notices by posting them on its noticeboard, and they count as served (Art. 147 CPI).
Do I need an Italian patent attorney?
No. Under Art. 201 CPI nobody is required to use a registered patent attorney before UIBM, and an applicant may act through an employee. If an agent is used, only one enrolled as an industrial-property consultant or a lawyer on the bar roll may act. ItaliaRegist is neither; we prepare and coordinate around the filing.
Can I file online from abroad?
Only with the right login. The UIBM online portal accepts SPID, CIE, CNS or eIDAS, and eIDAS opens it to citizens of other EU states. Without one of those credentials, the application is filed on paper at a Chamber of Commerce, by post to UIBM, or by an enrolled agent the applicant appoints.
How do we pay the Italian fees from a foreign bank?
An F24 (code C300; C301 for annual fees on a validated European patent) asks for the payer's Italian codice fiscale. From abroad, the fee goes by euro transfer to the Treasury account at the Banca d'Italia, with the details on UIBM's fees page. UIBM warns publicly about fraudulent payment requests, so pay only through these channels.
When must the filing tax be paid?
Within one month of the filing date, by the pre-filled F24 the Chamber of Commerce issues, under Art. 7(4-bis) of Law 102/2023 as the Milan chamber cites it. The term cannot be extended. A late payment makes the application irricevibile (inadmissible) by a reasoned UIBM decision notified to the applicant.
How long does it take to get the patent granted?
The sources we read publish no term for UIBM's examination or grant, so we quote none. UIBM states that the prior-art search needed for grant is carried out almost entirely at its own charge. The dates that do apply are the 12-month priority, the one-month payment of the filing tax and the annual fees.
What does the state charge to file a patent on paper?
EUR 120 up to 10 pages, EUR 160 for 11 to 20, EUR 400 for 21 to 50 and EUR 600 above 50, plus EUR 45 per claim beyond the tenth and EUR 200 if the claims have no English translation (Milan chamber). The first 4 years are included. UIBM states Italian costs are substantially lower than other countries'.
What does your filing coordination cost?
It depends on the route, how many titles and countries are involved, whether a European validation or an Italian holding company is part of the plan, and how much of the deadline is still open. We quote on request, after the first conversation. The state fees are separate and are listed in the table on this page.
How long does an Italian patent last, and what does it cost to keep?
Up to 20 years. Years 1 to 4 are covered by the filing tax; annual fees then run from EUR 60 in year 5 to EUR 650 a year from year 15 to year 20, each due by the last day of the month of the filing date (Milan chamber, maintenance fees).
What happens if an annual fee is missed?
Payment is still admitted in the following six months with a EUR 100 surcharge. After that, the patent lapses and falls into the public domain. If the grant comes after the end of year 4, fees already due may be paid without surcharge within four months of the grant (Milan chamber, maintenance fees).
Is a US or UK patent valid in Italy?
No. A patent protects only in the country where it is granted. Protection in Italy needs an Italian national filing, a European patent validated in Italy, or a PCT international application that enters its national or regional phase. A first filing abroad does keep a 12-month priority window for filing in Italy.
Why would a company hold the patent in Italy?
Under Art. 6 D.L. 146/2021, in force to 31 December 2026, R&D costs on copyright-protected software, patents and designs used in the business are increased by 110 percent for income tax, under a five-period option. Pre-grant costs count back up to eight periods. Whether it applies is a question for an English-speaking tax advisor for a foreign-owned Italian company.
Patent, utility model or design: what is the difference?
A patent covers an invention. A utility model covers an improved version of an existing product: EUR 120 for the first five years, EUR 500 for the second five. A registered design (disegno o modello) runs in 5-year periods up to 25 years, filing tax EUR 50 online or EUR 100 on paper. Which fits is for a conversation.
How does a European patent take effect in Italy?
By validation. Within three months of the European patent's issue, the holder files the validation forms at any Chamber of Commerce with the Italian translation of the text, claims and drawings, as Italy has not joined the London Agreement. Annual fees in Italy are then paid on F24 code C301. Protection equals a national patent.
What format do Italian patent numbers use, and where are they searched?
Since May 2015 UIBM gives every national filing a 15-digit application number. The F24 payment reference for an annual fee is that number followed by two digits for the year of the fee. The number can be looked up in the UIBM database (Banca dati UIBM), and we set up each annual payment from it.
