Filing from abroad: four ways in

The online portal is one channel of four, and the only one that needs a digital identity.

Online, with an EU digital identity

The UIBM portal admits SPID, CIE, CNS or eIDAS only; eIDAS opens it to EU citizens (Reggio Calabria Chamber of Commerce). Online access needs a digital identity (Art. 147 CPI).

On paper, at any Chamber of Commerce

The paper form is filed at the counter of any Chamber of Commerce, with one EUR 16 stamp per 4 pages and the EUR 40 chamber fee (MIMIT, trade marks and designs).

By post, to UIBM in Rome

The same paper form can be posted to UIBM in Rome, the third channel MIMIT lists. We assemble it with the specimen and the class list.

Through a registered agent or a lawyer

Representation is optional. If you appoint someone, only an agent on the industrial-property consultants' roll or a lawyer on a bar roll may act (Art. 201 CPI); the original letter of appointment carries EUR 34 (Milan chamber tariff).

Terms fixed by law: the filing date, three months for opposition, five years for use, ten years of protection.
  1. Clearance search and route

    UIBM examines absolute grounds only, so an earlier conflicting mark surfaces later, by opposition or invalidity action (Art. 170 CPI). We organise the applicant's search. No statutory term.

  2. Classes

    The goods and services are listed by Nice class; each class beyond the first adds EUR 34 to the EUR 101 filing tax (Milan chamber tariff). No statutory term.

  3. Who files and from where

    Portal, chamber counter, post, or an appointed agent or lawyer. A domicile in the EU or EEA is elected, with a PEC for a business (Art. 147 CPI).

  4. Pay and file

    Online, the stamp comes first, then the fee by F24 code C302, pagoPA or, from abroad, a Treasury transfer (UIBM). The payment day is the filing date (MIMIT).

  5. Examination by UIBM

    UIBM checks admissibility and form, then absolute grounds (Art. 170 CPI). No statutory term binds it and no official average or total time is published.

  6. Publication and opposition

    After publication, an opposition may be filed within three months, a peremptory term, in Italian (Art. 176 CPI). If one is filed, a two-month conciliation window follows UIBM's notice (Art. 178 CPI).

  7. Registration

    UIBM registers the mark; no official figure gives the date. We check any payment demand against UIBM's own channels.

  8. Use and renewal

    Genuine use is due within five years of registration (Art. 24 CPI). Protection lasts 10 years from filing; renewal is EUR 67 for one class, up to 6 months late with a EUR 34 surcharge (Milan chamber tariff).

What the state charges, channel by channel

What a non-resident applicant puts together for an Italian filing (MIMIT; Art. 147 CPI).

  • The applicant's identification data, for a person or a company
  • An elected domicile (domicilio elettivo) in any EU or EEA state
  • A PEC (posta elettronica certificata, certified email) address if the applicant is a business
  • A clear specimen of the mark
  • The goods and services, listed by Nice class
  • Where an agent acts: the appointment, a deed or a lettera d'incarico (letter of appointment)
  • Where priority is claimed: the priority documents, within 6 months

Without a domicile, UIBM posts notices on its noticeboard, served that day (Art. 147 CPI). A company can file in its own name, whether set up through the Italian company formation process or taken from the ready-made companies page; its registered office in Italy can come from our legal address service.

Five places a filing from abroad stalls, and what we do.

"UIBM accepted a mark that clashes with ours"

Acceptance says nothing about earlier marks: UIBM examines absolute grounds only, and an earlier owner acts by opposition or invalidity (Art. 170 CPI). We organise the clearance search before any fee is paid.

"We have no address in Europe"

Every applicant elects a domicile in an EU or EEA state; without one, UIBM serves notices on its noticeboard (Art. 147 CPI). We settle the domicile and the PEC before the filing.

"We cannot log in to the portal"

The portal takes SPID, CIE, CNS or eIDAS only. We prepare the paper filing for a Chamber of Commerce counter or the post, or coordinate the agent or lawyer you appoint (Art. 201 CPI).

"An opposition arrived, in Italian"

Oppositions run three months from publication, in Italian (Art. 176 CPI). The applicant replies, alone or through a registered agent or lawyer; we coordinate documents, translation and deadlines.

"A payment demand arrived after publication"

UIBM has warned of fraudulent payment requests in its managers' names and fake registration certificates. We check every demand against UIBM's own channels first.

Frequently asked questions

Can I file an Italian trade mark from abroad without an Italian digital identity?

Yes. Online filing needs SPID, CIE, CNS or an EU eIDAS identity, but the portal is only one channel. The paper form can be filed at any Chamber of Commerce counter or sent by post to UIBM in Rome (MIMIT), or a registered agent or lawyer you appoint can file for you (Art. 201 CPI).

Do I need an Italian address?

No. Every applicant must indicate or elect a domicile in any EU or EEA state, and a business also gives a PEC certified email address (Art. 147 CPI). Without a domicile, UIBM serves its notices by posting them on its noticeboard, and they count as served that day.

Do I have to hire a trade mark lawyer in Italy?

No. Article 201 of the Industrial Property Code says no one is obliged to be represented before UIBM, and an employee may act for a company. If you do appoint a representative, only an agent on the roll of industrial-property consultants or a lawyer on a bar roll may hold the mandate.

Can you file the application for us?

We prepare the class list, the application data, the domicile and the PEC, the fee sheet and the payment route, and we coordinate the filing. The applicant files, on paper or online, or a registered agent or lawyer they appoint does, because representation before UIBM is reserved to them (Art. 201 CPI).

Does UIBM check whether someone already owns a similar mark?

No. UIBM's technical examination covers absolute grounds only (Art. 170 CPI). An earlier conflicting mark surfaces later, when its owner files an opposition or an invalidity action, so the clearance search before filing is the applicant's job. We organise that search before any fee is paid.

How long does it take to register a trademark in Italy?

No official total is published, and no statutory term binds UIBM's examination. The fixed terms are the three-month peremptory window for opposition after publication (Art. 176 CPI) and, if an opposition is filed, UIBM's notice within 2 months of that deadline and a 2-month conciliation window (Art. 178 CPI).

How fast can the filing date be secured?

For an online application, the filing date is the day the fees are actually paid (MIMIT). If the fee is paid later by F24, the legal filing date moves to the payment day. Once the class list, the specimen and the domicile are ready, the filing itself takes a day.

How much does it cost to trademark a name in Italy?

The government filing tax is EUR 101 for one class plus EUR 34 for each additional class (Milan chamber tariff). On paper, add one EUR 16 stamp per 4 pages and the EUR 40 chamber fee; online, the stamp duty is printed as EUR 48 by one chamber and EUR 42 by MIMIT. Our work is quoted on request.

How do I pay Italian trade mark fees from abroad?

By a euro bank transfer to the Treasury account held at the Banca d'Italia in favour of the Ministry of Economy and Finance, as UIBM's fees page sets out. The same fees are also paid by F24 with tax code C302 or through pagoPA. We prepare the fee sheet that lists each amount and its channel.

Can you register a trademark internationally from Italy?

An Italian mark can be extended abroad by a Madrid international application filed through UIBM as office of origin. The Italian basic fee is EUR 135, plus EUR 34 where a letter of appointment is filed, paid by F24 code C302 (UIBM fees page). WIPO's own fees are separate and are not covered here.

Should I file an Italian mark or an EU trade mark?

We set out the conditions; the choice is yours. An EU trade mark covers every member state for EUR 850 online for one class, and a non-EEA applicant may file it alone but must be represented afterwards (Regulation (EU) 2017/1001). An Italian mark costs EUR 101 for one class (Milan chamber tariff).

How do I register a brand in Italy, step by step?

Run a clearance search, list the goods and services by Nice class, choose the channel and elect an EU or EEA domicile, then pay, which fixes the online filing date. UIBM examines the application on absolute grounds, publishes it and, after the three-month opposition window (Art. 176 CPI), registers the mark.

How long does protection last, and how is it renewed?

Ten years from the filing date for both the Italian and the EU mark, renewable for further ten-year periods (MIMIT; Regulation (EU) 2017/1001). Italian renewal costs EUR 67 for one class plus EUR 34 per additional class, and can be made up to six months late with a EUR 34 surcharge (Milan chamber tariff).

Do I have to use the mark?

Yes. The mark must be put to genuine use within five years of registration (Art. 24 CPI). If it then goes unused for five consecutive years without a proper reason, it can be revoked. We put the five-year date into the deadline calendar we hand over after the filing.

What happens if someone opposes my application?

The opposition must be filed within three months of publication, in writing and in Italian (Art. 176 CPI). UIBM then notifies the parties within 2 months of the deadline, a 2-month conciliation window follows, and an opponent whose mark has been registered for 5 years or more must prove its use within 60 days on request (Art. 178 CPI).
